ORA by Casa Tua Terms and Conditions

How to use this website and the rights Florida law gives new construction condominium buyers.

Last updated: October 2026

These ORA by Casa Tua terms govern your use of this website and explain the rights Florida law gives buyers of new construction condominium residences. Please read them before relying on any information here. By using this site, you accept these ORA by Casa Tua terms.

1. Who Operates This Website

This website is operated by our team at Fortune Christie’s International Realty, a real estate brokerage licensed by the Florida Department of Business and Professional Regulation (DBPR), 110 Washington Ave, Miami Beach, FL 33139, telephone +1 305 571-6319. We are a licensed broker representing buyers and marketing residences at ORA by Casa Tua.

This is not the developer’s official website. Under these ORA by Casa Tua terms, we are not the developer, the condominium association or an escrow agent, and we do not speak for them. You can verify any Florida real estate license at the DBPR license search, myfloridalicense.com.

2. ORA by Casa Tua Terms on Information Accuracy

Prices, deposit schedules, floor plans, square footages, views, finishes, amenities, rental policies and completion dates on this site come from developer marketing materials and can change at any time without notice. Renderings and photographs are artist conceptions and may not reflect the finished building.

Under these ORA by Casa Tua terms, nothing on this website is an offer to sell or a solicitation to buy in any jurisdiction where an offer requires prior qualification. Only a written purchase agreement signed by you and the developer creates a binding obligation.

3. ORA by Casa Tua Terms on Oral Representations (Section 718.503)

Florida law requires every condominium purchase contract to state on its first page that oral representations cannot be relied upon as correctly stating the representations of the developer. For correct representations, refer to the purchase agreement and to the documents required by section 718.503, Florida Statutes, to be furnished by the developer to a buyer or lessee.

The same rule applies to these ORA by Casa Tua terms: statements made by phone, WhatsApp, email, social media or in person, including by our team, do not change or add to the developer’s written documents.

4. Your 15-Day Right to Cancel a New Construction Contract

Under section 718.503(1)(a), Florida Statutes, a contract to buy a residential condominium unit from a developer must state in conspicuous type that the agreement is voidable by the buyer. You may cancel by delivering written notice to the developer within 15 days after you sign the contract and receive all of the documents the developer is required to provide.

If the developer later gives you an amendment that materially alters or modifies the offering in a way adverse to you, a new 15-day cancellation period applies after you receive it. Any attempt to waive these rights is void. The right ends at closing, and you may extend closing by up to 15 days after receiving all required items. These ORA by Casa Tua terms summarize the statute; the statute and your contract control.

5. Documents the Developer Must Provide

Before your cancellation period begins to run, Florida law requires the developer to deliver the condominium offering documents. Under sections 718.503 and 718.504, these generally include the prospectus or offering circular, the declaration of condominium, articles of incorporation and bylaws of the association, the estimated operating budget and schedule of owner expenses, the purchase agreement and escrow agreement, plot plans and floor plans, and any management, maintenance or recreation agreements.

Under section 718.502, a developer must file these documents with DBPR’s Division of Florida Condominiums, Timeshares and Mobile Homes before entering into binding purchase contracts. Read every document carefully; under these ORA by Casa Tua terms, the official documents always take priority over anything on this website.

6. ORA by Casa Tua Terms on Deposits and Escrow (Section 718.202)

Section 718.202, Florida Statutes, protects buyer deposits on new construction condominiums that are not yet substantially complete:

  • First 10%: deposits up to 10% of the purchase price must be held in escrow by an independent escrow agent, such as a bank, a Florida attorney, a licensed title agent or a registered real estate broker. The developer and its affiliates cannot act as escrow agent.
  • Above 10%: amounts above 10% go into a special escrow account. The developer may use them for actual construction and development costs only if the contract allows it and construction has started, and the contract must carry a bold legend on its first page warning you of that use.
  • Not for marketing: escrowed deposits may not be used for sales commissions, advertising, loan costs, attorney fees or insurance.
  • Refunds: if you properly cancel, deposits are returned to you with any interest the contract provides. If the developer fails to comply, the contract is voidable and you may be entitled to a refund with interest.
  • Receipts: you may request a receipt from the escrow agent for your deposit.

The deposit plans shown on our ORA deposits page are marketing summaries. Under these ORA by Casa Tua terms, the escrow agreement in your contract governs.

7. ORA by Casa Tua Terms on Misleading Information (Section 718.506)

Section 718.506, Florida Statutes, gives buyers remedies if a developer publishes false or misleading information about a condominium offering. If you believe any material on this site is inaccurate, tell us and we will review and correct it. Confirm every material fact with the developer’s documents before you sign.

8. Florida Brokerage Advertising Rules (DBPR)

Our advertising follows the rules of the Florida Real Estate Commission, part of DBPR, including Rule 61J2-10.025, Florida Administrative Code, which requires real estate advertising to include the licensed brokerage name and prohibits false or misleading statements. Under these ORA by Casa Tua terms, the brokerage name appears on this site and its contact points.

9. ORA by Casa Tua Terms on Rentals, EB-5 and Investment Information

Information about short-term rentals, rental income, the EB-5 program, taxes or financing is general and is not legal, tax, immigration, securities or investment advice. Rental rights are set by the declaration of condominium and association rules and can change. EB-5 investments carry risk and are offered only through the issuer’s own documents. Consult licensed professionals before you act.

10. ORA by Casa Tua Terms on Brokerage Relationship

Unless you sign a written agreement establishing another relationship, a Florida real estate licensee is presumed to act as a transaction broker under section 475.278, Florida Statutes. Our team may be compensated by the developer when a sale closes. Ask us about our role and compensation at any time.

11. ORA by Casa Tua Terms on Fair Housing

We are committed to equal housing opportunity and comply with federal, Florida and local fair housing laws. We do not discriminate on any basis protected by law.

12. Privacy, Calls and WhatsApp Messages

Links to other websites, including Miami Real Estate Trends, are provided for convenience. To the extent allowed by law, we are not liable for decisions made in reliance on this website rather than on the developer’s official documents.
